1. Who we are
Backup Safe is provided by [TO COMPLETE: company name], [TO COMPLETE: registered address] ("we", "us"). By creating an account you agree to these Terms, our Privacy Policy, our Refund & Cancellation Policy and, where you store personal data in your databases, our Data Processing Agreement. If you use Backup Safe for a company, you confirm that you may accept these Terms on its behalf.
2. The service
Backup Safe makes scheduled and on-demand backups of databases you connect, encrypts them, stores them with our storage provider, checks every stored backup ("integrity check"), regularly restores backups into an isolated test environment ("restore test"), and lets you restore or download your backups. You can see the current features on our website.
3. Your account
- You must give a valid email address and keep your password (or the Google account you sign in with) secure. You are responsible for activity in your account.
- You may only connect databases you own or are authorised to back up, and you must give Backup Safe only the access it needs (a read-only user is enough for backups).
- Own-key encryption: if you turn it on, your backups can only be decrypted with your passphrase. We never have it and cannot recover it. If you lose it, those backups are permanently unreadable. Keep your recovery kit and passphrase safe.
- Tell us at [TO COMPLETE: support email] straight away if you think your account has been used without your permission.
4. Plans, trial and payment
| Plan | Price | Includes |
|---|---|---|
| Starter | $19 / month | up to 3 databases, daily backups kept 7 days, 20 GB storage |
| Pro | $49 / month | up to 15 databases, hourly or daily backups (hourly copies kept 48 hours, daily copies 30 days), 200 GB storage |
- Free trial: new accounts can start one 7-day free trial (one per customer), with a payment card. During the trial, limits are 2 databases and 5 GB. Unless you cancel before the trial ends, your chosen plan starts and your card is charged automatically.
- Billing: subscriptions are billed monthly in advance in US dollars and renew automatically until cancelled. Payments are processed by Stripe. Prices exclude taxes (such as VAT, GST or sales tax); where we are required to charge tax, it is added at checkout and shown on your invoice.
- Plan changes: you can upgrade or downgrade at any time in Billing; the price difference is calculated by Stripe for the rest of the billing period.
- Failed payments: backups keep running while the payment is retried. If it keeps failing, the subscription ends as described in section 9.
- Refunds: see the Refund & Cancellation Policy. We may change prices with at least 30 days' notice by email; changes apply from your next billing period after that notice.
5. Acceptable use
You must not: back up data you have no right to process; store unlawful content; try to access other customers' data or our systems beyond your account; probe, overload or disrupt the service; use the restore-test environment for anything other than testing your own backups; or resell the service without our written permission. We may suspend accounts that break these rules, after notice where reasonable.
6. Your data
- Your databases and backups remain yours. We process them only to provide the service, as described in the Privacy Policy and the Data Processing Agreement.
- Backups are encrypted (AES-256-GCM) before they are stored. Restore tests decrypt a backup inside an isolated environment that has no internet access; the temporary test database is deleted right after each test.
- You can download any of your backups at any time, decrypted in the database's standard format.
7. What backups can and can't guarantee
We work hard to make every backup restorable, and we tell you about every failure. But no backup service can guarantee every backup. In particular:
- A backup can only contain what your database lets Backup Safe read at that moment. If your database is unreachable, misconfigured or changes the access you gave us, backups fail; we email you when that happens.
- Backups are kept only for your plan's retention period, then deleted automatically.
- Restore tests run on the newest verified backup of each database about once a day, for backups up to 5 GB; other backups are integrity-checked but not restore-tested. A passed restore test shows that backup restored correctly in our test environment; it doesn't guarantee that a restore into your own environment works, which depends on your systems.
- When your storage is full, new backups pause until space is freed; existing backups are not deleted early.
- A restore overwrites the objects it contains in the target database. You choose the target and confirm it; check it carefully.
You remain responsible for deciding whether Backup Safe is enough for your needs (for example, whether you also keep your own copies), and for checking the email alerts and the dashboard.
8. Availability and changes to the service
We aim for high availability but do not promise uninterrupted service. Planned maintenance is announced in advance where possible. We may improve or change features; if we remove a significant feature you pay for, we will tell you in advance and you may cancel. We do not currently offer a guaranteed uptime level or service-level credits.
9. Cancellation and termination
- You can cancel at any time in Billing. Your plan stays active until the end of the period you have paid for.
- When a subscription ends, scheduled backups stop and your existing backups are kept for 14 days, so you can still download or restore them. We email you when it ends, after 7 days, and 24 hours before deletion. After that, all stored backups of the account are permanently deleted. Reactivating before then keeps them.
- You can delete your account and all its data at any time in Settings, or ask us to do it ([TO COMPLETE: support email]).
- We may end or suspend accounts that seriously or repeatedly break these Terms, or if we have to stop the service; except in cases of abuse we will give reasonable notice so you can download your backups.
10. Liability
To the extent permitted by law: the service is provided "as is"; we are not liable for indirect or consequential loss, loss of profit, or loss of data that a working backup would not have prevented; and our total liability in any 12 months is limited to the amount you paid us in those 12 months. Nothing in these Terms limits liability that cannot be limited by law (for example for fraud, or for death or personal injury caused by negligence), or your statutory rights as a consumer.
11. Changes to these Terms
We may update these Terms. We will email you about material changes at least 30 days before they apply; continuing to use Backup Safe after that means you accept them. If you don't, you can cancel before they take effect.
12. Governing law and contact
These Terms are governed by the laws of the country in which [TO COMPLETE: company name] is registered, and its courts have jurisdiction, without removing protections you have under the law of your own country. Questions: [TO COMPLETE: support email].
